What is Bill #120428?

This legislation requires all buildings in Philadelphia that are 50,000 square feet or larger to benchmark energy and water consumption data annually. This data will be made publicly available with the intent to drive competition in the building sector for energy efficiency and building performance.

Do my buildings need to comply with Bill #120428?

The following buildings must comply:

  • Any commercial building with indoor floor space of 50,000 square feet or more
  • All commercial portions of any mixed-use building where a total of at least 50,000 square feet of indoor floor space is devoted to any commercial use

Note that this definition includes most building types per the rules established in the regulation. Philadelphia Code § 9-3402 3(g) allows application for exemption for largely unoccupied buildings, exceptional hardship, and buildings in which process energy is the predominant end use. If you received a compliance letter and believe your building may qualify for an exemption, please contact us to find out how to apply for exemption with the Mayor's Office of Sustainability.

What is the deadline for compliance?

Data for the preceding calendar year must be submitted no later than June 30 annually. Buildings that fail to disclose their energy and water data are subject to a $300 fine the first month their data is late, and a $100/day penalty following the initial 30 days.
